Terms of Use

Please read these Terms and Conditions ("Terms") carefully before using the FORJA application ("App", "Service", "Application"). By accessing or using FORJA, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, downloading, installing, accessing, or using FORJA, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Medical Disclaimer, which are incorporated herein by reference. These Terms constitute a legally binding agreement between you and Erarta FZE ("Erarta," "we," "us," or "our"), the operator of the FORJA application.

2. Eligibility

You must be at least 18 years old to use FORJA. By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the Service under applicable laws
  • All information you provide is accurate and current

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. License and Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use. You may not:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App's functionality or servers
  • Use automated systems (bots, scrapers) to access the App
  • Remove or alter any proprietary notices, trademarks, or branding
  • Use the App to provide services to third parties or in any commercial capacity

5. Intellectual Property

All content, features, functionality, software, text, graphics, logos, and other materials in the App are owned by us or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws. You do not acquire any ownership rights by using the App.

6. User-Generated Content

You retain ownership of any data, information, or content you submit to the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely to provide and improve the Service.

You represent and warrant that your User Content:

  • Does not violate any third-party rights or applicable laws
  • Is accurate to the best of your knowledge
  • Does not contain harmful, offensive, or inappropriate material

7. Privacy and Data Protection

Your use of FORJA is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information and health data. By using the App, you consent to such collection and use as described in the Privacy Policy.

8. Subscription and Payment Terms

Certain features of FORJA may require a paid subscription. By purchasing a subscription, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide accurate and current payment information
  • Automatic renewal of subscriptions unless canceled before the renewal date
  • All fees are non-refundable except as required by law or as explicitly stated

We reserve the right to modify pricing with notice to active subscribers. Continued use after a price change constitutes acceptance of the new pricing.

9. Disclaimers and Health Warnings

FORJA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Any information, calculations, or recommendations are accurate or reliable
  • Defects will be corrected or that the App is free from viruses or harmful components
  • The App will meet your specific needs or expectations

You acknowledge and agree that use of FORJA is at your sole risk. All health and medical disclaimers in our Medical Disclaimer are incorporated into these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERARTA FZE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the App
  • Any unauthorized access to your account or data
  • Any errors, omissions, or inaccuracies in the App's content
  • Personal injury or property damage resulting from your use of the App
  • Any other matter relating to the App

In no event shall our total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Erarta FZE and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Termination

We reserve the right to suspend or terminate your access to FORJA at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended inactivity

You may terminate your account at any time by contacting us or through the App's settings. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including disclaimers, limitations of liability, and indemnification provisions.

13. Third-Party Links and Services

FORJA may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the content, products, or services offered by third parties. Your interactions with third-party sites are governed by their respective terms and privacy policies.

14. Updates and Modifications

We reserve the right to modify, update, or discontinue any aspect of FORJA at any time without notice. We may also update these Terms periodically. Your continued use of the App after changes constitutes acceptance of the modified Terms. Material changes will be communicated through the App or via email.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Sharjah, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of FORJA shall be resolved through binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with its rules, seated in Dubai, United Arab Emirates, except where prohibited by law.

You and Erarta FZE agree to waive any right to a jury trial or to participate in a class action lawsuit.

You may opt out of this arbitration agreement by emailing support@forja.erarta.ai with the subject line "Arbitration Opt-Out" within 30 days of first creating your account, or within 30 days of the "LAST UPDATED" date above if you created your account before that date, stating your name and the email address associated with your account. Opting out does not affect the validity of the rest of these Terms.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Erarta FZE regarding your use of the App and supersede all prior agreements or understandings.
